American Home Shield denied my claim: how the appeal works

The appeal

Ask, in writing, for the service contractor's diagnosis report and the specific section of your plan the denial relies on. AHS plans cover unknown pre-existing conditions that could not be detected by visual inspection or simple mechanical test, so a 'pre-existing' denial should come with an explanation of how the company decided the failure was detectable. Request a second-opinion contractor; the plan allows it in many cases. Escalations go through the customer relations team by written request; keep the claim number on every message.

Arbitration, small claims, and the home-state regulator

The plan has a binding arbitration clause with a class-action waiver and a small-claims carve-out. Read the dispute section of your own plan for the opt-out window, usually 30 days from purchase.

The ladder, for this company

  1. Written appeal by certified mail within 30 days of the denial, with the claim number, asking for the technician's report and the clause relied on.
  2. Complaint to your state's regulator (find it) and, if different, the company's home-state regulator named above.
  3. Public complaint through the Better Business Bureau, which the company answers in public.
  4. Small claims for the gap if it fits under your state's cap; otherwise the arbitration named in the plan.
