The regulator

What to send the regulator
- The denial letter or email, with the claim number.
- Your written appeal and the company's response, or the date you sent it and the silence since.
- The contract page the company relies on, and the page that covers the item.
- The technician's report if you have it, and the repair or replacement quote.
- One paragraph: what failed, when, what they said, what you want. The kit writes it.
Small claims in California
Small Claims Court, generally up to $12,500 as of 2025; confirm on the court's site. confirm Most home warranty contracts require arbitration but carve out small claims. If the gap between the quote and the offer fits under the cap, small claims is usually the shorter road; the company has to send someone or settle.
In order
- Written appeal by certified mail within 30 days of the denial date, asking for the technician's report and the exact contract clause. Keep the receipt.
- Regulator complaint the same week, with the appeal attached. Regulators generally require the company to respond in writing within a few weeks.
- Public complaint through the Better Business Bureau. The large companies answer nearly all of them.
- Small claims for the gap if it fits under the cap; otherwise the arbitration the contract names, where the consumer's filing fee is capped by the arbitration provider's consumer rules.
